TERMS OF SERVICE – SWIPEHUB

1. General Provisions
1.1. These Terms of Service (“Terms”) govern your use of the SwipeHub website, applications, AI‑powered features, browser‑based micro‑tools, and any related products or services (collectively, the “Services”).
1.2. SwipeHub is operated by OSKAR ZAJĄCZKOWSKI, an individual entrepreneur / sole proprietor established in Poland (hereinafter "SwipeHub", "we", "us", or "our").

1.3. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must immediately stop using the Services.
2. Definitions

| Generated Output | Any content created, generated, transformed, summarised, translated, analysed, or otherwise produced by the Services in response to user instructions. |
| User Content | Any Content submitted, uploaded, transmitted, stored, or provided by a user, including prompts, files, feedback, reviews, ratings, and communications. |
| Services | All websites, applications, APIs, browser tools, AI systems, software, documentation, and related functionality provided by SwipeHub. |
3. Eligibility
3.1. You may use the Services only if you:
- have full legal capacity to enter into binding agreements under applicable law;
- use the Services in compliance with all applicable laws;
- are not subject to international sanctions or export restrictions.
3.2. If you are under the age of majority in your jurisdiction, you may only use the Services with the permission and supervision of a parent or legal guardian.
4. User Accounts
4.1. Registration requires accurate, current, and complete information.
4.2. You are solely responsible for all activity that occurs under your Account.
4.3. You must immediately notify us of any unauthorised access or security breach.
4.4. We reserve the right to suspend or terminate Accounts that violate these Terms or pose a security, legal, or operational risk.
5. Availability of the Services
5.1. We continually improve the Services and may:
- add, modify, suspend, replace, or remove features;
introduce experimental functionality;
perform maintenance; - temporarily interrupt access;
- discontinue parts of the Services.
5.2. We make reasonable efforts to minimise disruptions, but we do not guarantee uninterrupted availability.
6. Acceptable Use
6.1. You agree to use the Services responsibly and lawfully.
6.2. You must not:
- violate any applicable law or regulation;
- infringe intellectual property rights;
- upload malicious software, viruses, or harmful code;
- attempt unauthorised access to systems or databases;
- interfere with the operation or security of the Services;
- bypass security measures or rate limits;
- use automated systems to scrape or harvest data without authorisation;
- impersonate another person or organisation;
- distribute unlawful, defamatory, harassing, threatening, or discriminatory material;
- engage in phishing, fraud, or deceptive practices.
7. AI Services
7.1. SwipeHub provides AI‑powered tools intended as assistance only.
7.2. Generated Output:
- does not constitute legal, medical, financial, engineering, or other professional advice;
- should be independently reviewed before reliance;
- may contain inaccuracies or errors;
- may resemble output generated for other users.
7.3. You remain solely responsible for verifying and using Generated Output.
8. User Content
8.1. You retain all ownership rights to your User Content.
8.2. By submitting User Content, you grant SwipeHub a non‑exclusive, royalty‑free, limited licence to host, store, process, reproduce, transmit, display, and moderate your User Content solely for the purpose of providing the Services.
8.3. This licence ends when your User Content is permanently deleted from our systems, except where retention is required by law or for legitimate security, legal, or backup purposes.
8.4. You represent and warrant that:
- you own or have all necessary rights to your User Content;
- your User Content does not violate any law or third‑party rights;
- your User Content does not contain malicious code.
9. Generated Output
9.1. Subject to your compliance with these Terms, SwipeHub assigns to you any rights we may have in Generated Output created specifically in response to your inputs.
9.2. We do not guarantee the uniqueness or exclusivity of any Generated Output.
9.3. You are solely responsible for determining whether your use of Generated Output infringes third‑party rights.
10. Intellectual Property
10.1. All intellectual property rights in the Services (including software, source code, interfaces, trademarks, logos, algorithms, and platform architecture) remain the exclusive property of SwipeHub or its licensors.
10.2. Without prior written consent, you may not:
- copy, modify, distribute, sublicense, decompile, or reverse engineer any part of the Services;
- create derivative works;
- commercially exploit any part of the Services.
11. Feedback and Suggestions
If you voluntarily submit suggestions, ideas, bug reports, or other feedback, you grant SwipeHub a perpetual, irrevocable, worldwide, royalty‑free licence to use, reproduce, modify, and commercialise that feedback without compensation or attribution.
12. Third‑Party Services
12.1. The Services may integrate with third‑party providers (e.g., AI providers, hosting, analytics, advertising).
12.2. Your use of third‑party services is governed by their own terms and privacy policies.
12.3. SwipeHub is not responsible for the availability, security, or legality of third‑party services.
13. Advertising
13.1. SwipeHub may be supported by advertising provided by third‑party partners (including Google AdSense).
13.2. We do not control the content of advertisements and do not endorse any advertised products or services.
13.3. Display of advertisements does not constitute a recommendation or guarantee by SwipeHub.
14. Privacy and Data Protection
14.1. The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.
14.2. We process data on the following legal bases (under GDPR):
- Contractual necessity – to create and manage your Account;
- Legitimate interest – to prevent abuse and ensure security;
- Consent – for newsletters, analytics cookies, and advertising cookies (consent is voluntary and can be withdrawn at any time).
15. Cookies and Similar Technologies
15.1. We use cookies, local storage, and similar technologies for authentication, session management, security, analytics, and advertising.
15.2. Essential cookies do not require consent; non‑essential cookies (analytics, advertising, functional) are set only after you give your explicit consent via our cookie banner.
15.3. You may change your cookie preferences at any time.
16. Security
16.1. We implement reasonable technical and organisational measures to protect the Services.
16.2. No online service is completely secure. You are responsible for the security of your own device and credentials.
16.3. If you discover a security vulnerability, please report it responsibly to support@swipehub.my – do not disclose it publicly until we have had time to respond.
17. Monitoring and Enforcement
17.1. We may monitor the operation of the Services and investigate suspected violations.
17.2. Where appropriate, we may:
- issue warnings;
- remove content;
- restrict functionality;
- temporarily suspend or permanently terminate Accounts;
- report unlawful activity to competent authorities.
18. Suspension and Termination
18.1. We may suspend or terminate your access if:
- you violate these Terms;
- we reasonably suspect unlawful activity;
- your use poses a security risk;
- we detect technical abuse or fraud;
- we are required to do so by law.
18.2. Where reasonably possible and legally permissible, we will notify you before permanent termination.
18.3. Termination does not affect rights and obligations that accrued before termination.
19. Disclaimer of Warranties
19.1. The Services are provided using reasonable skill and care.
19.2. We do not guarantee that the Services will be:
- available at all times;
error‑free; - free from harmful components;
- meet your expectations.
19.3. For consumers, these disclaimers apply only to the extent permitted by applicable law. Consumers retain all statutory warranty rights under their national laws.
20. Limitation of Liability
20.1. For consumers: We are liable in accordance with the mandatory provisions of applicable law (e.g., Polish Civil Code). Nothing in these Terms excludes liability for fraud, intentional misconduct, or gross negligence.
20.2. For business users: Our total liability is limited to direct damages actually incurred, up to the total fees paid by you in the 12 months preceding the event.
20.3. We are not liable for:
- loss of data (unless you failed to back up);
- loss of profits or opportunities;
- damages arising from third‑party services;
- force majeure events.
21. Indemnification
You agree to defend, indemnify, and hold harmless SwipeHub from any claims, damages, or expenses arising out of:
- your use of the Services in violation of these Terms;
- your violation of applicable law;
- your infringement of third‑party rights (including intellectual property).
22. Compliance with Law and the Digital Services Act (DSA)
22.1. You must comply with all applicable laws.
22.2. SwipeHub complies with Regulation (EU) 2022/2065 (Digital Services Act) to the extent applicable.
22.3. Reporting illegal content:
- You may report content that you reasonably believe is illegal by emailing support@swipehub.my.
- Reports must include: identification of the content, a description of the illegality, and your contact details.
- We will review each report within a reasonable time.
22.4. Internal complaint‑handling:
- If we remove your content or suspend your Account, you may appeal that decision within 14 days of receiving the notice.
- Appeals should be sent to support@swipehub.my; we will re‑examine the decision.
22.5. Out‑of‑court dispute settlement:
You have the right to choose a certified out‑of‑court body to resolve disputes concerning content moderation, as provided under Article 21 of the DSA.
23. Intellectual Property Complaints
23.1. If you believe your copyright, trademark, or other intellectual property rights are infringed, send a written notice to support@swipehub.my containing:
- identification of the protected work;
- identification of the allegedly infringing material;
- your contact details;
- a good‑faith statement;
- a statement that the information is accurate.
23.2. Knowingly submitting a false complaint may result in legal liability.
24. Export Controls and Sanctions
You may not use the Services in a way that violates export control laws, embargoes, or international sanctions.
25. Force Majeure
We are not liable for delays or failures caused by circumstances beyond our reasonable control (e.g., natural disasters, wars, cyberattacks, supplier failures).
26. Assignment
26.1. You may not assign your rights or obligations under these Terms without our prior written consent.
26.2. We may assign these Terms to a third party in the event of a merger, acquisition, or asset sale. We will notify you at least 30 days in advance and you may terminate the agreement without penalty.
27. Severability
If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
28. No Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
29. Entire Agreement
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and SwipeHub.
30. Changes to these Terms
30.1. We may update these Terms for valid reasons (e.g., legal changes, service evolution).
30.2. We will notify you of material changes at least 30 days in advance via email or a notice on the website.
30.3. If you do not accept the changes, you may terminate the agreement without cost before the changes take effect.
30.4. Continued use after the effective date constitutes acceptance of the changes.
31. Governing Law and Dispute Resolution
31.1. These Terms are governed by Polish law.
31.2. For consumers: Any disputes shall be submitted to the competent courts of your country of residence.
31.3. For business users: Disputes shall be submitted to the courts having jurisdiction over SwipeHub’s registered address.
31.4. Consumers also have the right to use out‑of‑court dispute resolution methods (e.g., mediation, arbitration).
32. Electronic Communications
By using the Services, you consent to receive electronic communications (e.g., Account updates, security notices) at the email address you provided.
